Business As Well As Labor Are Assisted By Workers Compensation

The law states that any employee who loses a limb while on the job will receive the maximum workers compensation payment that is available. New York's current rate of payout for this kind of injury is $400 weekly for a total of 312 weeks. For an injured employee who is unable to be cured, such as a permanent lower back injury that is diagnosed by a doctor, these weekly payments can continue for the rest of the employee's life.

This unusual idiosyncrasy is because of a law established regarding workers comp in 1914. While it was a landmark law at the time and set up a rule for many work-related disabilities and injuries, it did not cover everything.

One of the things the law specified was a time line of benefits paid for loss of hearing or of a limb. However, for other disabilities that aren't mentioned within the law, whether they are partial or permanent, benefits will be paid indefinitely. Back pain and mental duress are two types of disabilities that are covered.

This has led to a workers compensation system that pays a disproportionate percentage, nearly 70 percent, to a mere 13 percent of all workers compensation matters. The workers comp premium paid in New York is 72 percent above the average around the United States. Local schools, businesses and governments are feeling the pain of paying out tax dollars and premiums.

On the other hand, $400 a week, which is the maximum benefit which can be collected in New York, is much lower when compared with surrounding states'. Local New York governments have taken note of these disparities and have begun developing plans to address the issues. In other states, the maximum benefit has been set as high as $685 per week.

Texas, previously had one of the worst workers? compensation systems in the nation. However, changes have been made to the system, it has the nation?s third-highest workers? compensation costs and the highest rate of injured employees.

Texas also has an issue with a continually developing number of dropout physicians. In response, the government has amended the law to offer a minimal increase in benefits given to injured employees and emphasize new doctor systems. Today, the workers compensation laws in Texas are considered to be one of the best in the United States.

Currently, there are discussions in New York which have suggested reducing the benefit payout period for partially disabling conditions to a maximum of ten years. They are also discussing an increase up to $500 for the maximum weekly benefit payout. Experts estimate that by implementing both of these changes, premium costs could be cut by approximately 15%.

It is hoped that an introduction of additional ideas and proposals to the government could help in raising their benefits even higher. For those working to find a solution to the worker's compensation issues, the best way to ensure success is to look for a middle-of-the-road solution that will provide something to everyone. It will also eliminate those endless payments to back pain sufferers.

California has already enacted similar reforms of its own workers compensation laws. They were able to petition the state to put the issue up for vote on the ballot. The publics overwhelming support for his position pressured lawmakers to take action themselves.

With the lack of a choice for a petition drive, the key to attaining New York's reformation is by motivating frontrunners to bring that issue to the forefront. This should be a priority for all state governments across the country, as this is essential to the survival of businesses that are struggling and local governments that can no longer carry the burden.
