Go to: Previous Article Next Article

A personal injury lawyer must be endowed with a combination of attributes to help a client win a settlement from a negligent wrongdoer. When the claimant and the defendant do not come up with an amicable settlement, the case is brought to be heard on court. However, not all of the personal injury cases brought to court end up successfully, if they do end at all. Some cases just do start formidable but end up waning in strength to reach a settlement that will benefit the client and the lawyer. Most of the burden of proof relies on the claimant's collection of evidences and validity of claim, however, the lawyer also plays a big part of making or breaking a good case in personal injury claims.

Lawyers are naturally inventive and competent to do their jobs, as a result of years of experience. Clients however are naturally innocent about filing settlement cases and must be directed properly to find the right professional lawyer that they need. One of the most important things that a lawyer and the client should have is a good partnership. This will enable the team to exchange vital evidences freely and come up with a well-documented personal injury claims. Initially, the lawyer must establish good rapport to secure the client's confidence. This will facilitate an easy professional relationship which will lessen the stress that is already experienced by the client.

The personal injury lawyer must also be competent with a proven record of winning similar cases as the client's. A lawyer who is familiar with how things are done in a personal injury claims is less likely to be influenced by a good rebuttal from the defendant. Moreover, a confident lawyer will easily influence a client to be confident on his or her own injury case. A good judge also takes note of a claimant's and the defendant's body languages. An individual who looks confident and positive is more likely to get the attention. Another important trait that a good injury lawyer must have is determination. A competent and confident lawyer without determination is good for nothing. Personal injury claims could take as little as a few months to several years before a judge may come up with a decision. The length of verdict is largely dependent on the case's being sensational and timely and if it involves prominent individuals as some or all of the parties involved in the case. A good lawyer sticks with the client until a decision is carried out.

A good personal injury lawyer must agree with a reasonable contingency. A contingency is an agreement to split the client's potential settlement. Some countries and states require a "no win, no pay policy", hence, the need for a contingency, however, a contingency must be settled between the claimant and the lawyer. This may involve millions in terms of monetary compensation so that a portion of the settlement is clearly an already huge amount. Some clients find themselves agreeing to split the settlement but end up getting nothing because some personal injury law firms come up with hidden charges that result to their getting most of the client's compensation.

In the end, the client gets a smaller portion than what was intended and settle with the compensation out of despair. A proper personal injury lawyer takes into account the client's interest so it is also important that the lawyer must be honorable and must have a good personal background. If a lawyer possesses all these qualities, then the client has a good chance of winning an easy settlement.
